These Terms of Service ("Terms") govern your use of the website messageafterdeath.com and the message delivery service provided by Message After Death, operated by Heezy LLC ("we," "us," or "our"). By accessing our website or purchasing our service, you agree to be bound by these Terms.
Please read these Terms carefully before using our service. If you do not agree to these Terms, do not use our website or purchase our service.
Message After Death provides a private message storage and delivery service. Customers write a personal message and designate a recipient. We securely store that message, monitor official records to verify the customer's passing, and then deliver the message to the designated recipient via certified mail.
This service is not a legal document. It is not a will, a trust, an estate plan, or a substitute for any legal instrument. For legally binding documents regarding your estate, we recommend consulting with a licensed attorney.
You must be at least 18 years of age to use our service. By purchasing our service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
Option 1 (Direct Message): You write your message directly on our secure online form, provide recipient information and your identity details for death verification, and submit the form. After submission, you are directed to complete payment through Stripe.
Option 2 (Downloadable Form): You purchase the service through Stripe and receive a downloadable form via email. You complete the form at your own pace and return it to us by email. We then store your message under the same terms as Option 1.
The current price for each service option is listed on our website. The fee is a one-time payment. There are no recurring subscription charges. The one-time fee covers secure message storage, ongoing death verification monitoring, and certified mail delivery to your designated recipient.
Each purchase covers one message to one designated recipient. If you wish to send messages to multiple recipients, a separate purchase is required for each.
All payments are processed through Stripe, a secure third-party payment processor. We do not store your payment card details. By providing payment information to Stripe, you agree to Stripe's terms of service and privacy policy.

You are responsible for providing accurate and complete information when you use our service. This includes your full legal name, date of birth, hometown, and recipient details. Inaccurate information may result in a failure to verify your passing or a failure to deliver your message.
If any of your information changes (including recipient name or address), you are responsible for notifying us so we can update our records. You can contact us at info@messageafterdeath.com to make changes at any time.
You agree that your message will not contain any of the following:
We do not read your message and therefore cannot pre-screen for prohibited content. However, if we become aware that a message contains prohibited content, we reserve the right to refuse delivery and, if necessary, report the matter to law enforcement.
If you change your mind after purchasing our service, you may request a refund or cancellation by contacting us at info@messageafterdeath.com.
If you request cancellation, your message and all associated personal information will be permanently deleted within 30 days of your request. This action cannot be undone.
You may update, replace, or modify your stored message at any time by contacting us at info@messageafterdeath.com. We will work with you to ensure your message reflects your current wishes. There is no additional charge for modifications.
We understand that our customers are placing long-term trust in us. We are committed to maintaining this service for as long as there are messages in our care awaiting delivery. In the event that we are unable to continue operating, we will make every reasonable effort to transfer stored messages and delivery obligations to a qualified successor service, or to notify customers (or their designated contacts) so that alternative arrangements can be made.
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is available on our website and is incorporated into these Terms by reference.

Some jurisdictions do not allow the limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Message After Death, Heezy LLC, and their owners, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or the content of your stored message.
These Terms are governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Umatilla County, Oregon.
We may update these Terms from time to time. If we make material changes, we will update the effective date at the top of this page. Your continued use of our service after any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you may cancel your service and request deletion of your message.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Message After Death regarding your use of our service and supersede any prior agreements or understandings.
